How to Get Started


  • The first step in divorce proceeding is when one spouse files a petition with the court.

  • The spouse who files for divorce will need to file proof of service. This shows the court that the other party has been notified.

  • When the divorce filing spouse needs temporary support from the other spouse for child support and other needs.

  • When a party has divorce filed against them they need to respond and potentially dispute the ground for the divorce.

  • Parties don’t always agree to all the terms of the divorce and sometimes need to negotiate different terms.

  • In Massachusetts divorce proceeding are hear by a bench or Judge trial.

  • Once a Judge has ruled on the proceedings he or she will then issue a judgement or the “rules” for the divorce settlement.

  • After judgement a divorce becomes final after the “nisi” or waiting period. In 1A divorces this is 120 days.
